Fracking will get go-ahead even if Lancashire refuses, legal advice suggests
‘Fracking in Lancashire is likely to get the go-ahead at appeal even if the local council rejects it, legal advice issued to councillors suggests.
Cuadrilla is seeking permission for fracking in the UK for the first time since 2011, and has submitted planning applications for two sites in the county.
If councillors refuse consent for Cuadrilla’s proposed Preston New Road site there is a “high risk that a costs penalty will be imposed upon the council” at appeal, according to the advice by David Manley QC.
Such a cost penalty would only be imposed if the council lost its case, legal experts said.’
